Resolution 2021-107 -- A Resolution Authorizing Changes to the OSRD-IP Development Plan for the Windstone Subdivision

Resolution 2021-107 requests approval of a minor change to the OSRD-IP Development Plan for the Windstone Subdivision, which is located on the south side of Murray Lane.  
Background
The attached resolution requests approval of a minor change to the facilities within the permanent open space in the Windstone Subdivision.

At its regular meeting of September 7, 2021 the Planning Commission voted to approve a minor modification to the previously approved OSRD-IP Development Plan for the Windstone Subdivision. The change involves the creation of a 20-foot wide public utility easement (PUE) across Open Space Area "A". The easement is intended to provide electric service to the home, which is currently under construction at 866 Windstone Boulevard (Lot 29).

As part of the review, the Planning Commission also recommended approval of the minor modifications to the Development Plan to the Board of Commissioners. Also, as part of the September agenda, the Planning Commission approved a revised final plat for Lot 29, which when recorded will establish the proposed public utility easement. 

As mentioned above, the change involves the creation of a 20-foot wide PUE, intended to provide electric service to Lot 29. The lot includes an area of 7.74 acres, is located on the ridgetop and accessed from the end of Windstone Boulevard via a 30-foot wide private access and public utility easement. The lot lies adjacent to a narrow open space area, being approximately 50-feet wide, which is also designated a scenic easement. The proposed PUE runs diagonally through the open space and includes an area of approximately 2,619.40 square feet (0.060 acres). Electric service would be extended from the Heathrow Hills subdivision over to Lot 29. The service will be placed underground as required by Section 70-1 of the Municipal Code.

The modification will also require revision to the recorded scenic easement document.  The revised document must be provided for staff review and recorded along with the revised final plat.  The scenic easement document and the final plat must both reference the recording of each document.
 
Finally, the Windstone HOA has approved the minor modification to Open Space Area "A".  Additionally, the development plan was originally drafted by staff with the SouthernLand Company (SLC).  However, digital copies of the plan no longer exist. SLC has granted permission to the applicant to complete the minor modifications to the plan showing the proposed public utility easement.  

Because the  OSRD-IP Development Plan proposes minor changes to the facilities within the open space by adding the PUE, the revised OSRD-IP Development must be approved by the Board of Commissioners, per the requirements of Section 78-185(b) of the Code.

Staff Recommendation
Staff recommends approval of Resolution 2021-107.
Previous Commission Action
On January 12, 2009 the Board of Commissioners approved Resolution 2009-02 . The proposed changes involve the addition of one (1) residential lot plus an increase in the amount of permanent open space for the development. The current OSRD Development plan for the subdivision includes 110 total lots.
