Background
The subject property for which extension of service is requested is located at 2500 North Berry's Chapel Road. The property includes an area of approximately 5.7 acres and is located on the east side of North Berry's Chapel Road within the City's Urban Growth Boundary (UGB). Williamson County Property Assessor records show that there is one house having an area of approximately 3,977 sq. ft. on the property. The home is serviced by a septic system, which according to the owners of the property is failing. The property owner is requesting that the City extend sewer service to the property.

Sewer service can be extended to the subject property from the public sewer main located in the Holly Tree Farms subdivision (see attached map).  Because the property is located within the City's UGB it was included in the sewer system master plan evaluation and modeling for the ultimate sewer system build out.  As required by City and Water Service Department standards, the property owners would be required to fund the installation of the sewer infrastructure to the subject properties.  The current property owners have agreed to fund the extension of the force main as needed and at their expense and pay applicable out of city tap fees.  Section 70-132 of the Municipal Code further requires the payment of $1,900.00 grinder pump replacement fee. Payment of this fee allows the property owners to participate in the City's grinder pump maintenance program.

Staff has had several conversations with the applicants over several years. They are aware that the City does not annex properties then extend utilities to serve any future development.  Policy 7.C.1 in the 2030 Plan states -- “In territory adjoining the City where development is proposed, the City will pursue a cost-effective program of annexation within the limits of State law, to ensure the land use complies with the City’s zoning ordinance and subdivision regulations and that appropriate infrastructure is provided.  The City will not annex property and extend municipal services beyond the existing limits solely to promote new development that would not otherwise occur without the provision of Municipal Services.”

The property is currently zoned by Williamson County as Municipal Growth Area -- 1 (MGA-1). The intent of the MGA-1 district is to provide areas adjacent to cities to remain largely undeveloped until such a time as the land may be annexed into a municipality. Until such annexation, the municipal growth areas are considered a part of the County’s rural landscape and as such, this district is established to protect the rural character of Williamson County by allowing for agricultural, rural, and low-density residential development. The minimum lot size required is one acre.  The maximum gross density is one dwelling unit per acre. 

The owners plan to construct a residential addition having an area of between 400 and 500 sq. ft. to the main house to allow for an additional bedroom. Additionally, a small attached cottage having an area of approximately 1,200 sq. ft. is also planned. There are no plans to subdivide the property.  If approved, the sewer extension authorization will only be for service to the existing main dwelling unit and an accessory dwelling unit of no more than 2,000 sq. ft.  No additional structures on the property will be allowed to connect to the City's sewer system.  These limitations will be specifically addressed in a sewer service agreement that will be recorded with the Register of Deeds and will be binding on any future property owners.
Staff Recommendation
Staff recommends approval of Resolution 2020-88, authorizing extension of sewer outside city limits to 2500 N Berry's Chapel Road in accordance with the provisions of the Municipal Code.

There has been on recent action by the Board of Commissions related to the subject property.
