Request for Issuance of a Certificate of Compliance to O.T. Investments, Inc. for Retail Sale of Alcoholic Beverages at the Brentwood Wine & Spirits, LLC (330 Franklin Road, Ste 202-B).
Background
O.T. Investments, Inc. is seeking a license for an existing liquor store located at 330 Franklin Road, Suite 202-B (new ownership).  The store, which has been in operation since 1999, operates under the name Brentwood Wine & Spirits and is within the commercial area known as Brentwood Place Shopping Center.  Although liquor licenses are issued by the Alcoholic Beverage Commission of the State of Tennessee, the applicant must present a certificate of compliance from the local government as a prerequisite.  Issuance of a certificate of compliance is non-discretionary, and is only related to the items specified in state law. The items to be certified by the City are shown on the attached certificate, which must be signed by the Mayor or a majority of the City Commission members.

As to the three items to be certified, the following information should be noted:
  1. A check of the applicant's records revealed no felony violations.
     
  2. The proposed location of the liquor store, within the C-2 zoning district, presents no conflicts with the location restrictions established by the City.  (Liquor stores within the City must be within a C-2, C-3 or C-4 district, and may not be within 300 feet of a religious institution, school, public library, governmental office, or a private residence which is in a residential district.)
     
  3. The City's ordinances allow one liquor store for every 6,000 residents as determined by the most recent official census.  There are currently six stores in Brentwood, and Brentwood Wine and Spirits is one of them.  Based solely on the 2018 Special Census population of 43,889, seven stores would be allowed in Brentwood.  However, other limitations currently preclude a seventh store, such as the ordinance allowing only three stores in the northern and three in the southern commercial districts of the City, and a State moratorium on new retail package store licenses in effect until July 1, 2021. 

The applicant meets all of the City of Brentwood requirements for the issuance of a certificate of compliance.
Staff Recommendation
