Background
In 1999, the City of Brentwood partnered with Williamson County and the developer of the Heritage senior living community on a series of land and infrastructure agreements that resulted in the various civic and institutional uses that exist today along Heritage Way north of Concord Road (see attached map).  Williamson County's participation in this arrangement provided for construction of the Indoor Sports Complex (ISC) which includes a natatorium, indoor tennis center, and exercise facilities.

Earlier this year, Williamson County Parks and Recreation staff met with City staff to discuss planned upgrades and improvements to the ISC--the first substantial capital investment in the facility by the County since it was first constructed.  The planned improvements include mechanical and lighting upgrades in the pool and tennis areas, the addition of a group fitness area, construction of four outdoor pickle ball courts on the east side of the existing indoor tennis courts, and expanded parking. Funding for these upgrades and improvements in the amount of approximately $5 million has already been committed by Williamson County.

As part of this discussion, Williamson County staff inquired as to whether the City would consider some level of financial participation in the project to add additional amenities to the ISC.  Items discussed included a gymnasium and outdoor splash pad.  Staff believes that a splash pad at the ISC would provide a unique and much needed family amenity given the growing number of families with children moving to the community.  By partnering with Williamson County as part of the planned ISC upgrades, the City would be able to provide this amenity without any long-term operational or maintenance obligations.  Note that the addition of a gymnasium remains part of the County's long term plan for the ISC, but the City is not making any commitment towards participating in the cost of that future improvement.

The concept of a partnership with Williamson County on this project was first discussed with the City Commission a couple months ago.  Based on the positive feedback at that time, staff has continued working with Williamson County staff and their design team to finalize the project proposal, which was presented to the City Commission at the August 23 City Commission briefing.

The attached Memorandum of Understanding provides for a financial contribution from the City of Brentwood in the amount of $1.5 million to provide for the addition of a splash pad to the County's existing upgrades planned for the ISC.  The County remains responsible for all other costs associated with the upgrades to the ISC.  Note that the cost of the splash pad includes not just the water play equipment, but all associated decking area, fencing, utility extensions, and construction of outdoor bathroom facilities to serve splash pad users.  The City's payment is due in one lump sum prior to the start of construction.  Assuming approval by both the  City and County Commissions by the end of October, Williamson County staff hopes to have the splash pad open by mid-summer of 2019.

From a financial perspective, approval of this funding commitment will necessitate a FY 2019 budget amendment later in the year.  As reported to the City Commission previously, the unaudited FY 2018 year end number for the unassigned General Fund balance (i.e. the City's "Rainy Day" fund) is projected to be approximately $37.7 million.  This amount is approximately $3.5 million higher than the $34.2 million conservative projection at  the time the FY 2019 budget was adopted in June of 2018.  Staff believes this better than expected financial result for FY 2018 provides an appropriate source of one-time funding for this contribution towards a significant new recreational amenity for the Brentwood community.
 
Staff Recommendation
Staff recommends approval of Resolution 2018-75 authorizing the Mayor to execute the Memorandum of Understanding with Williamson County.

No funds for this project were included in the adopted FY 2019 budget.  Therefore, a budget amendment will be required at the end of FY 2019 to provide for a transfer from the unassigned General Fund balance to the Capital Projects Fund for the purposes of funding the City's payment to Williamson County for this project.
