Background
The attached ordinance proposes several changes to Chapter 56 in regards to the land disturbance and grading permit requirements.

The ordinance defines a substantial rebuild lot as a lot on which a modification to the existing structure(s) or the lot itself, including but not limited to a residential addition, swimming pool, or other accessory building and structure, is proposed such that the increase in impervious surface is greater than or equal to 800 square feet. With the addition of this language, changes to lots that fall under this definition are subject to the requirements of a grading permit.
 
These requirements were originally implemented effective July 1, 2020 as a result of grading and drainage concerns associated with house demolitions and rebuilds, additions, the construction of swimming pools, and stormwatwer control measures during construction. Although these requirements have been in place under the authority granted to the Engineering Director by code, staff felt it best to explicitly add these to the code for clarity for staff and applicants. The proposed ordinance also includes language to ensure clarity in commercial properties requiring adherence to the Subdivision Regulations regarding stormwater quality and quantity measures. 

The Code provides that when required, a land disturbance plan is prepared by a licensed Tennessee professional engineer or landscape architect. Erosion control, drainage, and grading improvements are to be included on the plan as are existing conditions. 
 
There are several other proposed changes in the draft ordinance, most of which are "clean-up" items. Staff has attached a redline so that you can see all of the changes being proposed.

Planning Commission review of the proposed code amendments is not required. However, please note that the various stormwater related requirements for new development projects as identified in the Neel-Schaffer study completed this past spring are scheduled for Planning Commission consideration on September 7, 2021 as part of various Subdivision Regulation updates.

If approved on first reading, this ordinance will be scheduled for second and final reading on September 13, 2021.
