Background

In February 2021, survey crews from Ragan Smith field-located the streets, curbs and sidewalks that were installed in Traditions Subdivision Sections 3, 4 and 5. This survey was based on a request by the City of Brentwood Engineering Department after discovering discrepancies in the sidewalk location in reference to the right-of-way. The survey confirmed that the future public roadway was not constructed in the centerline of the right-of-way along Parade Drive and Traditions Circle. As a result, a portion of the public sidewalk on certain lots was installed beyond the platted right of way boundary resulting in the need for the addition of an access easement on these lots. The access easement is required for the sidewalk encroachments as shown on the attached exhibit.

Using the City's standard easement document, Ragan Smith has worked to obtain owner signatures for recording. A three-foot wide public access easement is being requested that will encompass all sidewalk encroachments on the affected lots. It should be noted there is an existing 20' public utility and drainage easement along lot frontage; however, it does not include access for sidewalk maintenance.

Staff Recommendation

The Access Easement Resolution is being requested for approval. The easements will be obtained by Ragan Smith on behalf of the Developer. These sections have not been turned over to the City, and securities remain in place for the public roadway infrastructure.
