Subject
Public hearing for Ordinance 2020-08, which requests the rezoning of approximately 10.27 acres located in the southeast quadrant of the intersection of Wilson Pike and Old Smyrna Road.  The requested change is from the SI-3 (Service Institution -- Cultural, Recreational and Governmental) zoning district to the R-2 (Suburban Residential) zoning district.  The subject property is commonly referred to as the "Dolphin Club" property and is located at 502 Wilson Pike. 
Background
Mr. Jim Spangler with Hidden Valley Homes is requesting the rezoning of the former Dolphin Club property located at 502 Wilson Pike.  The requested zone change is from SI-3 to R-2. 

While not legally binding like an OSRD Development Plan, the applicant has provided a preliminary concept site plan for an R-2 development. The plan shows a total of five residential lots on the 10.27 acre tract.  All proposed lots appear to meet the minimum lot area requirements of the R-2 zoning district.  The submitted plan shows one cul-de-sac from Old Smyrna Road that will provide access to all lots.  The existing driveway to Wilson Pike would be removed under this plan.  There shall be no access for individual lots from either adjacent arterial street.  The property is encumbered by 100-year floodplain. None of the proposed lots encroaches into the floodplain area.  The applicant is in the process of performing a final survey for the property. A survey is usually not completed until the preliminary plan or final plat stage of the process.  All lots will be developed in accordance with the technical standards of Article III, Division 4 (R-2) of the zoning ordinance and the requirements of the Subdivision Regulations. All of the the surrounding properties, including those across Wilson Pike and Old Smyrna Road are also zoned R-2 

The tract is located within the Little Harpeth River Drainage Basin.  Based upon the number of lots proposed (five) the development is proposing water and sewer service for up to 1,550 gpd each. The tract was included in the City's Sewer Master Plan and was projected to have a peak sewer flow of 7,000 gpd.  Based upon the information provided and the review of the impacted water and sewer collection system, staff with the Water Services Department has approved water and sanitary sewer service to the property for the proposed R-2 zoning.  The developer will be responsible for any water and/or sewer main extensions that may be required to connect to the public water and sewer system. 

Hidden Valley Homes has built homes in the Avery, Annandale, Brass Lantern Farms, Morgan Farms, and Oman subdivisions to name a few.  

HISTORY
In November 2007 and again in February 2008, the Planning Commission considered a proposed plan for the Brentwood Sports Academy.  The proposal included the construction of an 84,240-square-foot building on the former Dolphin Club property. At the request of the applicant the project was deferred several times.  The Planning Commission never approved the proposed sports complex for the property.

The property was sold in March 2008 to the Calvary Chapel Brentwood, which hoped at the time to build a church on the site. 

In August 2008, Calvary Chapel requested a preliminary concept plan review from the Planning Commission. The plan proposed that the project would be constructed in four phases, which would eventually result in the construction of a 42,000-square-foot church facility having 720 seats in the sanctuary and a total of 293 parking spaces.  The Planning Commission approved the proposed concept plan. 

In November 2017, the Calvary Church Brentwood sold the property to its current owner.  

In March 2018 the Planning Commission approved a plan for the property that proposed construction of a tennis facility having a building area of 36,000 sq. ft., which included six indoor tennis courts.  The existing six outdoor tennis courts were to be refurbished under this plan.  

The Planning Commission will review the rezoning request and provide its recommendations at its August 3, 2020 regular meeting. The community meeting, to explain the purpose for the rezoning and to answer any questions from citizens, was conducted on July 30 at the Library.  A total of 10 citizens attended the meeting. There were no major concerns expressed by the attendees. A summary of the meeting is attached below.  Second and final reading of the ordinance is scheduled for August 24, 2020.

Previous Commission Action
At its regular meeting of July 13, 2020, the Board of Commissioners voted unanimously, seven to zero (7-0) to approve Ordinance 2020-08 on first reading.  

At its regular meeting of May 12, 2014, the Board of Commissioners heard a request to rezone the former Dolphin Club property from SI-3 to C-1/SR to support a proposed independent living facility. The plan proposed 145 private suites, available in studio and one and two bedroom floor plans. The area of the suites ranged from 350 square feet for a studio to 1,000 square feet.  Each room would contain a "half kitchen" (similar to a wet bar, with a 3/4 refrigerator and a hand sink.)  No dishwashers, stoves or ovens are provided.  All meals are provided in a common dining room.  The proposal failed due to the lack of a motion.  

At its January 27, 1992 regular meeting the Board of Commissioners voted unanimously to approve Ordinance 91-67 on second and final reading.  The ordinance rezoned the subject property from R-2 to SI-3.
