Ordinance 2021-18 - Granting a Franchise to Atmos Energy Corporation
Background
On July 8, 1996, the City granted a franchise for the right, privilege, authority, and consent to place, construct, and manage gas lines within the City limits to United Cities. This franchise was subsequently transferred to Atmos Energy Corporation ("Atmos") on February 10, 1997. That initial franchise agreement had a term of 25 years, and it is now expiring. 

Staff has worked with Atmos to draft a new franchise with substantially similar terms as the original. Specifically, Atmos has the right to install, repair, maintain, and inspect its pipes within the City, and they will repair such areas to the original condition to the best of their ability. Additionally, Atmos will coordinate with the City on projects included in the capital improvement plan and the City and Atmos will work together to minimize costs and delays to both parties. The term of this agreement will be for 20 years.  

If passed on first reading on July 26, 2021, the ordinance granting the franchise will be scheduled for second and final reading on August 9, 2021. The franchise will have to be approved by the Tennessee Public Utility Commission and will become effective after that approval.
