Background
The City receives landscaping maintenance services for City Hall, the Service Center, and the John P. Holt Brentwood Public Library from Swift Lawn & Land ("Swift") through property management company Cushman & Wakefield, Inc.  Swift was selected by Cushman & Wakefield, the City's property management company from a group of three proposals in May 2021.  At the time Cushman solicited the proposals, it was expected that the Police Department Headquarters (PDHQ) would be added to the list of facilities they manage for the City.  Therefore, proposals included landscaping at the Police Headquarters in addition to the other three sites.  The City was subsequently unsuccessful in negotiating a contract with Cushman for the overall facility management of PDHQ, and as a result the facility will be managed directly by City staff. 

Given that Cushman has already solicited proposals and selected the low-price firm on the City's behalf, and because it is not desirable to have multiple landscaping contractors servicing City facilities, staff recommends waiver of competitive bidding and awarding the attached agreement to Swift Lawn & Land.  If approved, service will begin August 1, 2021.  The initial term of the agreement is one year, with services continuing on a month-to-month basis thereafter.

Fiscal Impact:
The FY 2022 Annual Budget, prepared prior to building opening, includes $20,000 for landscaping maintenance.  This proposal exceeds that amount by $9,200.  The difference will be covered by the absence of property management fees from Cushman & Wakefield.
