Background
The City of Brentwood's annual paving program for the 2019-2020 paving season includes the resurfacing of Andrew Crockett Court.  At the same time, Mallory Valley Utility District (MVUD) has plans to replace the water main along Crockett Springs Trail and Andrew Crockett Court. City staff has worked with MVUD to outline the associated costs specifically for the pavement restoration/resurfacing costs on Andrew Crockett Court. 

For the full length of its work, MVUD will be fully responsible for the replacement of the water main, backfilling of the trench, and placement of binder asphalt necessary to bring the repaired area flush with existing adjacent pavement.  MVUD has supplied the City with a Letter of Credit in the amount of $236,667, which would cover making the City whole in the event that MVUD, or their contractor, failed to fulfill its obligations relative to patching of the existing road.

Once the water line and pavement patching work is completed, the City's paving contractor will mill and repave both Crockett Springs Trail and Andrew Crockett Court.  MVUD and the City will equally share costs related to the milling and resurfacing of Andrew Crockett Court.  However, since no paving work was planned for Crockett Springs Trail, the entire cost related to milling and resurfacing will be the responsibility of MVUD.  MVUD's shared of the actual costs related to work on Crockett Springs Trail and 50% of the work on Andrew Crockett Court is not anticipated to exceed $91,906.00.  Under the terms of the agreement, MVUD will pay the City this amount up front, and the City will reimburse MVUD should the actual costs come in less than this amount.

Staff believes this is a fair and equitable arrangement that will result in a better final product at reduced cost to taxpayers.

Staff Recommendation
Staff recommends approval of the attached resolution authorizing a cost sharing agreement with Mallory Valley Utility District related to pavement repair/repaving along Crockett Springs Trail and Andrew Crockett Court.
