Acceptance of Water Utility Easement from HC Brentwood Original, LLC

Background

The Jason’s Deli renovations at the former Ruby Tuesdays (279 Franklin Road) required the addition of a new fire line to feed the building and meet current fire code. The new fire line requires a meter which is typically set at the property line. However, due to existing site conditions, the fire line meter was required to be set approximately 38’ from the property line. The water line from the property line to the meter is considered a public line and therefore requires an easement. The owner, HC Brentwood Original, LLC, is providing a water utility easement to cover the 38’ of fire line between the property line and the new meter.

Staff is recommending that the easement be accepted by the Board of Commissioners. If acceptance is approved, the easement will authorize future maintenance of the water line by the Water Services Department. Upon acceptance, the easement document will be recorded at the County Records Office and a copy returned to HC Brentwood Original, LLC. Staff recommends authorization for acceptance of the proposed water utility easement.
