Background
In 2022, the General Assembly of the State of Tennessee legislature passed bill to require all utilities to develop and implement a cybersecurity plan by July 1, 2023.  Under the new legislation, the Comptroller’s office is tasked with oversight of the new requirement.  The plan’s purpose is to protect the utility's facilities and customers from unauthorized use, alteration, ransom, and destruction of electronic data or system infrastructure.   Plans are required to be updated every two years.  Cities or utilities are subject to audits annually by the Comptroller’s office.     
 
Additionally, the Environmental Protection Agency has tasked states' environmental agencies with auditing the newly developed plans, as well as implemented practices and controls in order for utility system’s to maintain the integrity of infrastructure and provide for safe continuous operation.  For the City, these audits are to be completed during the utility system’s sanitary survey conducted periodically by representatives from TDEC.    
 
Accordingly, staff has developed the requisite plan based on various guidance documents published by EPA/TDEC and the Tennessee Comptroller.  Since the Technology Department maintains broader City Cybersecurity policies and action plans, this plan shall supplement and work in conjunction with those documents.  Also, since water and wastewater systems have been designated as critical infrastructure, certain information must be maintained as confidential pursuant to TCA §10-7-504, including the Cybersecurity Plan.  Therefore, the proposed Resolution before the Board has been created to permit adoption of the plan but the actual plan is not attached to the resolution to meet the confidentiality requirements.
