Background
The Tennessee Department of Environment and Conservation (TDEC) publishes a list of streams in Tennessee that are considered impaired (now referred to as streams with unavailable parameters).  The list is referred to as the 303d list.  Streams can be considered impaired for many reasons, but in urbanized areas like Brentwood the impairment is primarily for siltation (sediment) and loss of aquatic habitat caused by development activities.  Virtually all streams in urbanized areas are considered impaired.  Cities are required by TDEC to perform visual assessments of impaired streams in their communities to identify sources of impairment as well as to collect and test water samples from streams potentially impaired by activities within their jurisdictions.  The primary purpose of these stream activities is to develop corrective actions to reduce or eliminate the impairment and to assess the effectiveness of the stormwater program over time.  

Under Brentwood's stormwater permit issued by TDEC, the City is required to assess all impaired streams over a five-year permit cycle.  A map with highlighted stream segments that will be assessed over the current permit cycle is included in the attached proposal.  Also attached is an example stream observation that serves to illustrate the types of conditions noted during the assessment. The attached stormwater monitoring proposal was developed by Civil & Environmental Consultants, Inc. (CEC) to ensure we complete all visual assessments and sampling within the required timeframe.  Our original round of assessments began in 2011, with additional stream segments assessed each year.  Two subsequent 5-year cycle assessments have been completed since then.  We are currently in the third 5-year cycle.  As noted in Section 3.0 of the proposal, this fiscal year (Permit Year 2) will include visual assessments of Beech, Holt, and Spencer creeks.  E. coli sampling will be completed for Holt and Spencer creeks as required.  The proposal outlines work remaining to be completed this cycle but only FY 2024 is being contracted at this time. 

The cost to perform the required assessments and sampling for FY 2024 is $31,500, and adequate funding is included in the Engineering Department's proposed operating budget. CEC has assisted Brentwood since the inception of the City's stream assessment program and is best suited to provide the required continuing professional services.  The attached proposal includes additional details of the tasks to be performed.

Previous Commission Action
On February 28, 2021, the commission approved a contract with CEC for year five of the stream assessments, which completed the prior permit cycle analytical requirements.  At the January 24th, 2022 meeting the City Commission approved Resolution 2022-005 for MS4 requirements compliance for outfall monitoring and education only.  Year one of stream assessments for the current 5-year cycle was essentially skipped because TDEC delayed approval of the last year’s permit until September 2022, which was after completion of our FY 2023 budget.  The proposed agreement is for FY 2024, or year two of this permit cycle.  The required stream assessments and sampling required over the current five-year cycle will be completed in four years.
