Background
As you may recall, on October 26th, 2020, the Commission approved an agreement with TDOT for $2,196,000 in TDOT project funding through the Federal Highway Administration's Congestion Mitigation and Air Quality Improvement Program (CMAQ).  The agreement will provide for traffic congestion and ADA accessibility improvements in designated corridors. The City's share of the project will be $118,000, and the original agreement is attached.  

The original TDOT contract was executed on November 17, 2020, and it mistakenly stated that the City must receive Notice to Proceed (NTP) for construction within two years from that date, resulting in a deadline of November 17, 2022.

The final date for acquisition of the NTP should, as corrected, be three years from date of execution of the contract.  This proposed amendment corrects the mistake in the original contract and sets the final date for NTP as November 17, 2023.  As the NTP is essentially the deadline by which obligation of construction funding for the project must be received and approved by TDOT, it is crucial this date be reflected correctly in the contract.  Construction of the project must be completed within two years of the NTP, that is, by November 17, 2025.

Staff Recommendation
Staff recommends approval of the amended agreement with TDOT.
Previous Commission Action
The Commission endorsed application for this CMAQ grant at the November 11, 2019 meeting via Resolution 2019-97.  Subsequently, the Commission approved the original Agreement with TDOT on October 26, 2020.
