Resolution 2022-61 - Acquire ROW & Easements for Murray Lane Holly Tree Gap Roundabout

Resolution 2022-61 - Authorization to acquire needed right-of-way and easements for the Murray Lane at Holly Tree Gap Road roundabout improvement project.
Background
Right-of-way ("ROW") plans are nearing completion for the Murray Lane and Holly Tree Gap Road intersection. The intersection currently functions as a three-way stop and plans are to improve the intersection to a roundabout design.

The Commission previously approved a design agreement with the engineering consulting firm, Benesch, to complete the plans.  Since that time, staff has been working with Benesch on various aspects of the design including the horizontal and vertical layout, utility coordination, and storm drainage.  Staff will need to acquire easements and/or ROW for up to approximately nine (9) properties. This work is expected to begin late summer/early fall 2022. Commission authorization is required in order for staff to begin negotiations with the property owners.

With Commission approval, staff will move forward with the appraisal/ROW/easement acquisition process.

Previous Commission Action
Resolution 2021-55 on 6/14/2021 authorized Alfred Benesch and Company to proceed with project design. 

Resolution 2021-119 on 10/25/21 authorized Boozer & Company, P.C. to complete appraisal services for the referenced project. Appraisal services are expected to begin upon approval of this resolution.

The actual cost of the right-of-way and easements will be based on certified appraisals and negotiated with each property owner. The Capital Improvements Program for this project includes $130,000 between FY 2022 and 2023, which is intended to cover the cost of appraisals and the cost of acquiring the needed property.
