Resolution 2024-48 - Amendment to Design Services Agreement with TMPartners for City Hall Renovation Project.
Background
In October 2022, the Board of Commissioners approved an initial design services agreement with TMPartners for the City Hall renovation project.  The original contract fee was $196,050 based on a projected construction scope of work costing $3 million.  As development of the project progressed, there were several aspects of the project that changed and resulted in the need for additional design services.  These included:
 
  • A determination that the primary electrical system serving a significant portion of the first floor would have to be completely replaced to meet current code standards.  As a result of this, an in depth electrical phasing plan had to be developed to limit extended downtime for those areas of the building that would remain occupied during construction.  This necessitated expanded mechanical system design services.
  • The scope of work was expanded in some areas, the most significant of which was a decision to include renovation of the wet areas (showers/sinks) of the Fire and Rescue Department locker room due to aging plumbing and continued leaks, etc.
  • A decision late in the design process to reduce the overall scope of the project by eliminating almost all planned work on the second floor except for the public lobby and Fire Department areas.  This required that all project plans and specifications had to be reviewed and revised to eliminate this work and adjust any design for the remaining work that would be impacted by the elimination of the second floor work.
As a result of this additional work and scope, TMPartners submitted a fee adjustment request.  Staff reviewed the request and through negotiation with TMPartners is recommending approval of the attached fee adjustment request totaling $156,800.  If approved, this adjustment would bring the total design services agreement amount to $352,850.  This amount equates to approximately 7.2% of projected construction cost, inclusive of contingency allowance and furniture estimate.  This percentage is well within accepted standards for architectural design services as a percentage of construction budget.

Previous Commission Action
The original design services agreement with TMPartners was approved via Resolution 2022-108 on October 24, 2022.
