Background

Enclosed for the Board’s consideration is a request for time extension by the project contractor, Cunningham Construction and recommended for approval by the project engineer, Hethcoat and Davis.

As outlined in the recommendation letter by the project engineer, the request addresses both a conflict contained within the bidding documents and the final agreement in which the contract time as bid and presented in the pre-bid project meeting included a 730-day work schedule for final completion. However, the agreement form when executed between the City and the project contractor, contained an error in this schedule, indicating only 600 days for project completion. So the first part of the request remedies this error.

Secondly, for delays associated with pipe and other project material production and shipping, the project engineer reviewed order and delivery date information submitted by the contractor. The project engineer evaluated material delivery delays as to what is reasonable compared with historical market standards and determined that the contractor qualifies for a total of 230-day time extension associated with the material supply delays. Therefore, the project engineer is recommending a total of 360 days be approved for extending the contract time for final project completion. This establishes the new substantial completion date as March 13, 2025. There is no change in contract pricing with this change order.
