Background
To recap the history of this project, in April 2022, Resolution 2022-39 called for an agreement with ESP Associates, Inc. for Master Plan Services for Windy Hill Park.  In late November 2022, Resolution 2022-127 adopted the Windy Hill Park Master Plan.  In January 2023, an agreement was entered with ESP Associates, Inc. for Windy Hill Park Design Services.

With the design complete, staff recently solicited bids for construction. The City received only one bid, from Orion Building Corporation, in the amount of $4,100,093. While receiving multiple bids is always preferable, Orion is a qualified bidder based in Brentwood, and the bid amount is below the budgeted amount of $4.3 million set for construction. Given the favorable bid amount, staff is recommending approval of a construction contract with Orion and requesting that $200,000 be set as a contingency funding allowance for this project. Construction funding for the project is now proposed to be from American Rescue Plan (ARP) funds due to pending funding obligation deadlines.

In addition, staff brought before the commission in February the purchase of playground equipment for $185,000, which is outside this contract.  The total proposed construction cost is summarized below:

Attached is the proposed contract and Orion’s bid for your review. If approved, construction will begin this spring, and it is the goal to have Windy Hill Park open by the early summer of 2025.

At the February 1, 2024, Budget Kickoff Meeting, staff discussed an anticipated $4.5 million budget for the remainder of the Windy Hill Park project, with construction estimated at $4.3 million.  This bid price of $4,100,093 is within that amount.  Staff request that $200,000 be authorized as a contingency so that unforeseen conditions requiring change orders can be addressed without delay.    The full account number for the project is 311-44400-89700-3018.
