Resolution 2023-46 - Update to Occupational Health and Safety Program.
Background
As required by Tennessee Code Annotated §50-3-101 et seq., the City has adopted an Occupational Health and Safety program. The program was originally adopted in 1976. In September 2016, the City passed an ordinance which replaced Chapter 2, Article III, Division 5 of the Brentwood Municipal Code with an updated Occupational Safety and Health Plan of Operation. The updated Plan of Operation included the sections removed from the Brentwood Municipal Code.
In February 2023, the City was advised by TOSHA the current Plan of Operation needs to be updated to reflect the title change of the Safety
Coordinator
of Occupational Safety and Health to the Safety
Director
of Occupational Safety and Health. A revision to Section IX. EMPLOYEE COMPLAINT PROCEDURE is also requested to provide more specific guidance for the employee complaint procedure. Additional changes included in the revised Plan of Operation are primarily minor wording changes to clarify and strengthen the plan or remove obsolete references. See attached documents.

Staff Recommendation
Staff recommends passage of Resolution 2023-46 to update the current Plan of Operation to include the recommended changes keeping the plan current and up to date.
Previous Commission Action
Ordinance 2016-09 was approved unanimously on first reading at the September 12, 2016, Board of Commissioners' meeting.
