Resolution 2018-28- Authorization for the Acquisition of Right-of-Way and Easements for Improvements to Sunset Road
Background
The Capital Improvements Program includes funding for improvements to Sunset Road from the current Ragsdale Road/Sunset Road intersection project (approximately 600 feet north of Owl Creek) northward to Concord Road (see attached location map).  These improvements include a three-lane curb and gutter cross section with a 10 foot wide multi-use path along the west side of the road.

This project is considered Phase 2 of a three phase project to widen Sunset Road between Concord Road and the city limits at Waller Road.  Phase 1, which includes the realignment of the Ragsdale Road/Sunset Road intersection, is currently under construction and should be complete by the end of 2018.  From a scheduling standpoint, this Phase 2 project is planned to begin about the same time as the construction work on the Phase 1 project is being completed.  Sunset Road’s typical roadway section will also be 3-lane with curb and gutter and a 5’-0” grass area behind the curb that could contain a future sidewalk.  The road will have a minimum proposed right-of-way width of 66’-0” (see attached cross-section).

The attached resolution authorizes staff to proceed with property acquisition negotiations with the hope of having all necessary right-of-way and easements secured by fall of 2018 so the project can be bid and construction started by the spring of 2019. Construction work is expected to last approximately 16 months.

The full cost of design and construction is reflected in the proposed 2019-2024 CIP over the course of three fiscal years.  Assuming no problems with environmental permitting or right-of-way acquisition, construction is tentatively projected to begin in spring of 2019 and to be complete by summer of 2020.

Funding of $1,000,000 is allocated to this project in the proposed Capital Projects Fund for right-of-way (ROW) and easement acquisition in FY 2019, and $5,250,000 for construction is programmed in FY 2019 and FY 2020.

Final design work is ongoing.  To maintain projected schedules, the City needs to proceed with ROW and easement acquisition on three parcels on the east side of Sunset Road (one being our Safety Center) and potentially one on the west side (Governor's Club).  Therefore, staff is recommending City Commission provide formal authorization for the Mayor, City Manager and City Attorney to negotiate, acquire and condemn (if necessary) sufficient right-of-way and easements to allow this important project to move forward.
