Background
In March 2023, the City approved a performance agreement with the Developer of the Ragsdale Subdivision, located at 1647 Ragsdale Road, to proceed with the construction of the subdivision in a more timely manner since the timing of the project's infrastructure work and the planned City road improvements to Ragsdale Road do not coincide.  This creates a logistical problem for both parties.  This agreement addressed road improvements to be completed by the Developer, over and above what is otherwise required as a condition of their project approval in order that the City may avoid additional future costs potentially incurred as a result of construction of the Ragsdale Road widening project anticipated later in 2024.  The approved performance agreement outlined the commitments of the Developer and the City including the City’s condition to directly reimbursement the Developer for a portion of the expected additional costs.  
 
In addition to the road improvement work negotiated with the Developer, Water Services has been in discussion with the Developer to install a portion of water line in the area of the subdivision entrance which coincides with the Developer’s work on the road improvements near the entrance.  The planned road work includes construction of a significant retaining wall that would make it very difficult to install this section of water line that is scheduled to be installed with the road widening construction late in 2024, early 2025.  By having the Developer’s contractor install a section of approximately 300 feet of 12 inch water line simultaneously with the wall and lane widening construction, the City can avoid deconstructing a portion of the new construction and having to rebuild it back, which would add unnecessary cost and disruption for the City.  Once installed, the City’s contractor, during the road construction project, can connect to the end of the water line and then progress forward without disrupting the newly constructed facilities.   
 
To facilitate this work, Water Services has negotiated with the Developer to install approximately 300 linear feet of 12 inch ductile iron pipe, beginning near the entrance of the development and extending northward to a point clear of the developer’s road construction limits.  Based on an engineered plan for this section of waterline as reviewed by Water Services staff, the agreed upon estimated cost for construction is $77,254.56 which includes a 15% contingency allowance to address field changes resulting from unknown conditions.  Engineering fees included in this amendment total $15,000 for a total project reimbursement of $92,255. 

Under this agreement, the City will commit to reimburse the developer for this work by direct payment with the final amount calculated based on actual construction costs incurred by the Developer during construction, in an amount not to exceed the total project cost, unless prior approval is granted by the Board of Commissioners.  This work and cost greatly benefits the City as referenced above in that it saves cost that would otherwise be required if this portion of water line was constructed with the City’s road widening project.   City staff will have access to the project at all times to conduct all necessary inspections and observe material quantities installed.
