Tennessee Code Annotated Section 6-51-108(c) requires that a public hearing and report on the progress of the extension of municipal services to annexed property be presented to the governing body of the annexing municipality and published in a newspaper of general circulation upon expiration of six months after the annexation. The McAdams property, located south of the Taramore Subdivision, was annexed pursuant to Resolution 2021-29 on May 24, 2021. The resolution included a Plan of Services, which detailed the provision of municipal services to the property.
The full text of Tenn. Code Ann. Section 6-51-108(c) reads as follows:
(c) Upon the expiration of six (6) months from the date any annexed territory for which a plan of service has been adopted becomes a part of the annexing municipality, and annually thereafter until services have been extended according to such plan, there shall be prepared and published in a newspaper of general circulation in the municipality a report of the progress made in the preceding year toward extension of services according to such plan, and any changes proposed therein. The governing body of the municipality shall publish notice of a public hearing on such progress reports and changes, and hold such hearing thereon. Any owner of property in an annexed area to which such plan and progress report are applicable may file a suit for mandamus to compel the governing body to comply with the requirements of this subsection (c).
All City services including police and fire protection, emergency communications, public works road maintenance, planning, zoning, and codes enforcement oversight have been extended to the property. Additionally, future residents will be provided full access to all existing and future recreational facilities, parks, greenways, bikeways, etc., in the City. Finally, future residents in the area will have access to the John P. Holt Brentwood Library. These services will be provided automatically to all future residents.
Sewer and water service to the property is provided by the City of Brentwood, via existing infrastructure that currently lies in New Bristol Lane in the Taramore Subdivision (Phase 12). The water service area was transferred to the City from the Nolensville College Grove Utility District in 2006. The developer of the property is responsible for extending the utilities to the future homes.
The notice of the public hearing was published in the November 24, 2021 edition of the Williamson Herald.
