Background
On February 12, 2012, the City Commission approved an original sponsorship agreement with the Nutro Company for the City's only dog park, located within Tower Park.  That original five-year agreement recently expired.  Mars Petcare has merged with the Nutro Company. Staff recently met with Mars Petcare representatives to discuss the company's interest in continuing the sponsorship of the park. Staff is pleased that Mars Petcare has agreed to continue the sponsorship for an additional three years. Attached to this resolution is a proposed three year sponsorship agreement with Mars Petcare.  Under the terms of the agreement Mars Petcare will make annual payments to the City in the amount of $5,000 during the term of the agreement, for a total of $15,000. The funds will be deposited in the Parks Trust Fund (a dedicated "Funds Held in Trust" account within the General Fund) and will be used for extraordinary maintenance and equipment purchases for the dog park.

Other major highlights of the attached agreement include the following:
  • Mars Petcare will have exclusive pet food and treats distribution rights at the dog park;
  • Subject to approval from the Parks Director and proof of required insurance, Mars will have the ability to host events at the dog park, including: distribution of coupons, samples, and/or giveaways to dog park patrons, and “Meet Up” events at the dog park for dog owners;
  • Recognition on the dog park page of the City’s website.
The agreement does include adequate safeguards to protect the City’s best interests, including prior approval of the dates for events to insure there is no conflict with other peak park uses. Either party will have the right to terminate the agreement with 30 days notice prior to the next automatic annual renewal date.  Also, either party will be able to terminate the agreement at any time should there be adverse publicity about the other party that is deemed to have a negative impact.

The carrying out of activities and special events at the dog park by Mars is seen as a positive benefit to dog owners and the Parks Department. This is a program that is outside the normal scope of park activities and should encourage greater use of the facility by dog owners. This involvement will also have a positive financial benefit to the City and reduce the need for public funds to enhance and maintain the dog park in the future.   At its March 6, 2017 meeting, the Park Board unanimously approved the proposed sponsorship agreement.

One main difference with this agreement besides the term of the agreement is that Mars Petcare is not seeking naming rights to the dog park. The company prefers that the City name the park but recognize Mars as the official sponsor.  Out of six potential names provided by staff, the Park Board has recently selected Barkwood Dog Park as the name it is recommending to the City Commission for adoption.  An agenda item to officially name the dog park will be on the Commission's March 27, 2017 agenda.

Staff Recommendation
The staff recommends approval of the accompanying resolution authorizing a sponsorship agreement with Mars Petcare and official naming of the park.

The projected annual income under this three year agreement will be deposited in the Parks Trust account of the General Fund. Accumulated funds will be used for future enhancements and extraordinary maintenance needs at the Dog Park based on recommendations from the Parks Director and approval by the City Commission as part of the six-year Capital Improvements Program.
