Resolution 2017-17 - Authorizing Acceptance of a Public Access Easement for a Multi-Purpose Trail in the Avery Subdivision

Resolution 2017-17 - authorizing acceptance of a multi-purpose pedestrian easement traversing the arterial road buffer along Murray Lane in the Avery Subdivision.  
Background
The approved OSRD plan for the Avery Subdivision includes an eight foot wide public access easement for a multi-purpose walking trail that meanders through the arterial road buffer along Murray Lane. The subdivision is located on the east side of Murray Lane, located approximately 800 feet south of the Scales Elementary School campus. 

Ordinance 2015-11 was approved by the Board of Commissioners on second reading on October 12, 2015.  The width of the trail shown on the original OSRD plan was modified from six feet to eight feet with the approval of Resolution 2016-29.  The current configuration of the path was further modified by the approval of Resolution 2017-01. The final plat was approved by the Planning Commission on January 3, 2017 and showed a 28 foot wide public access easement (eight foot wide trail, ten foot easement on either side of the trail).  


There are no sidewalk facilities along Murray Lane on the adjacent properties in the area.  There is, however, an existing sidewalk along Waterford Place that extends to its intersection with Murray Lane.  Funding has been programmed  in the FY 2017 Capital Projects Fund budget for installation of pedestrian facilities along Murray Lane from the Avery subdivision north across the front of the Waterford subdivision to Scales Elementary School, and also south of the Avery subdivision to Forest Park Drive, which would allow children living in these subdivisions to more easily walk or bike to school. While there are some significant drainage challenges to these proposed public trail extensions, Public Works staff is working towards installation of these trail segments later this calendar year. 

Please note that the plan/plat shows a looped segment of the pedestrian path located in the northwestern potion of the open space that is six feet wide.  This portion of the trail will be private and is not included as part of the public access easement. Its maintenance will be the responsibility of the future homeowners association.  


Since the multi purpose trail will eventually provide public access to Scales Elementary and the subdivisions to the south, the public access easement needs to be acquired in the City's name, requiring formal authorization from the City Commission for acquisition and acceptance of this public access easement.

Previous Commission Action

At its January 10, 2017 regular meeting, the Board of Commissioners voted to approve Resolution 2017-01, which authorized an alteration to the improvements within the arterial road buffer along Murray Lane reducing the length of the multi-purpose trail within the arterial road buffer approximately 333 feet, or from 1,533 linear feet to 1,200 linear feet. The approved plan also increased the area of the permanent open space for the project from 5.83 acres to 6.85 acres.  

On June 14, 2016 the Board of Commissioners approved Resolution 2016-29, which authorized changes to the OSRD Development Plan for the Avery subdivision.  The changes involved a reduction of one lot, to a new total of 23 lots, an increase in the area of the excess open space and a modification to the improvements within the arterial road buffer (open space) for the project.

Also at its June 14, 2016 regular meeting the Board of Commissioners voted to approve Resolution 2016-30, which authorized acceptance of a stream mitigation plan for the Avery subdivision.  The mitigation area is within Primm Park, located along the south side of Moores Lane.  


On October 12, 2015 the Board of Commissioners voted unanimously, seven for and zero against to approve Ordinance 2015-11, which rezoned the property for Avery subdivision and adopted the OSRD plan.
