MINUTES OF MEETING OF BRENTWOOD BOARD OF ZONING APPEALS

The Brentwood Board of Zoning Appeals met on Monday, February 20, 2023 at 7:00 pm at Brentwood City Hall.

BZA2212-002 - Accessory Structure Request – Annandale Subdivision, Section 2, Lot 39, 363 Jones Parkway, Zoning OSRD - Applicant: Kevin Kosiek, Artis Construction Company, 3613 Stone Creek Drive, Spring Hill, TN 37174

Artis Construction requested approval of a 384 square foot detached structure to be constructed in the rear buildable area of the lot. The structure will be constructed of stucco colored to match the existing house. It will have a clay tile roof and be approximately 18 feet tall. The height of the house is approximately 26 feet tall.

The department recommended that the following 4 requirements be attached to the approval of the request:
  1. Except on parcels of three or more acres in size, no accessory building shall be designed and/or used for living or sleeping quarters. If proposed, this would require a separate BZA review and approval. 
     
  2. Accessory structures cannot be used for home occupation/commercial purposes.
     
  3. Complete plans shall be submitted for review, approval, and issuance of a building permit.
     
  4. Any changes to the building or site plans will require staff review and re-approval from the Board of Zoning Appeals prior to issuance of a building permit.

Staff recommended approval of the detached accessory structure, subject to all building codes and staff notes.

BZA2301-001 - Accessory Structure Request – Walnut Ridge Subdivision, Section One, Lot 51, 6757 Walnut Hills Drive, Zoning OSRD - Applicant: Anne Jost, Exodus Industries, 1850 General George Patton Drive, Suite B-100, Franklin, TN 37067

Exodus Industries, Inc. requested approval of a 572 square foot detached structure to be constructed in the rear buildable area of the lot. The structure will be constructed of stacked stone with wood accents. It will have a shingle roof and be approximately 15 feet tall. 

The department recommended that the following 4 requirements be attached to the approval of the request:
  1. Except on parcels of three or more acres in size, no accessory building shall be designed and/or used for living or sleeping quarters. If proposed, this would require a separate BZA review and approval. 
     
  2. Accessory structures cannot be used for home occupation/commercial purposes.
     
  3. Complete plans shall be submitted for review, approval, and issuance of a building permit.
     
  4. Any changes to the building or site plans will require staff review and re-approval from the Board of Zoning Appeals prior to issuance of a building permit.

BZA2301-002 - Accessory Structure Request – 9390 Crockett Road, Zoning R-2 - Applicant: John Swift, Province Builders LLC, 615 Napoleon Avenue, Nashville, TN 37211

Province Builders, LLC requested approval of a 3,500 square foot detached structure to be constructed in the rear buildable area of the lot. The structure will be constructed of metal painted charcoal to match accents of the house. It will also have a metal roof and be approximately 22 feet tall. The height of the house is approximately 33 feet tall.

The lot includes an area of 4.96 +/- acres. Section 78-22(3) allows two accessory buildings on parcels of at least three but less than five acres in size. 

The Board of Zoning Appeals previously approved a 1,126 detached pool house with sleeping quarters at the June 20, 2022 meeting. 

Section 78-22(8) allows the Board of Zoning Appeals to waive the requirement that exterior materials and roof pitch be compatible with the principal structure if it is determined that neighboring properties and the surrounding neighborhood in general will not be harmed.
 
The department recommended that the following 5 requirements be attached to the approval of the request:
  1. Installation of landscaping improvements as shown on the approved plan must be installed before a Certificate of Completion will be issued.
     
  2. Except on parcels of three or more acres in size, no accessory building shall be designed and/or used for living or sleeping quarters. If proposed, this would require a separate BZA review and approval. 
     
  3. Accessory structures cannot be used for home occupation/commercial purposes.
     
  4. Complete plans shall be submitted for review, approval, and issuance of a building permit.
     
  5. Any changes to the building or site plans will require staff review and re-approval from the Board of Zoning Appeals prior to issuance of a building permit.
Staff recommended approval of the detached accessory structure, subject to all building codes and staff notes.
