Background
The Water Services Department’s Capital Improvements Program for FY2020-2025  includes the Brentwood/Metro Sewer Pumping Station Storage Facility construction project.  The storage facility project includes the storage facility (tank) and related pumping and piping infrastructure proposed to be constructed adjacent to the Brentwood/Metro sewer pumping station located approximately ½ mile west of Hillsboro Road.

To successfully complete this project, the City will need to acquire land and permanent and construction easements from area property owners.  Preliminary discussions have been ongoing with the land owners, but in order to begin more definitive discussion staff needs the Commission's approval.  The owners have expressed interest in selling their 44-acre parcel that surrounds the existing pumping facility.  There have also been discussions centered around the purchase of a few acres or the minimum needed for the planned facilities.  The surrounding land is significantly encumbered by flood plain, TVA power lines, existing sewer lines from the City and Metro/Nashville and a large Harpeth Valley Utility District water line.

In order for staff to acquire the property needed for this proposed construction project, staff is requesting authorization for the Mayor, City Manager, and City Attorney to move forward with negotiations for the acquisition of land and easements.  This could include condemnation of property should a non-amicable resolution result. Without authorization to use the right of condemnation as an ultimate last option, it is possible the City will be unable to meet its Corrective Action Plan obligations to have the tank completed and operational by the end of calendar year 2022.
