Background
At its January 13, 2015 meeting, the Board of Commissioners approved a rezoning of the property for the Witherspoon Subdivision. The plan subsequently approved by the Planning Commission included construction of a network of multi-use trails within the development as well as connections to the existing public trail network in the area.  One of the proposed connections on the east side of the development was a stub to the neighboring property owned by the Raintree Forest HOA near their amenity area. 

The proposed new trail connection (map attached) would extend from the existing trail along Raintree Parkway, across the HOA property, and to the new trail in the Witherspoon subdivision.  While other connections to the public system were paid for by the developer (see Witherspoon map atttached) because they benefited the Witherspoon residents, this connection benefits the current residents of Raintree Forest and other users of the existing trail along Raintree Parkway, and will also serve as part of the long-term plan for bike and pedestrian facilities along the Crockett Road corridor between Wilson Pike and Concord Road.  As a result, this segment is planned to be funded by the City.  This proposed trail connection was discussed at the time of the initial approval of the subdivision and has been part of the plan since the approval of the subdivision development plan.

The Witherspoon developer is currently working on construction plans for the section that will include the stub to this planned new connection. The next step in the project development process is to conduct a property survey and engineering design work.  Staff is recommending utilizing the services of Sullivan Engineering, Inc. (SEI) for this work.  SEI handles most of the City's roadway design work and is familiar with the City's project objectives related to construction cost and property impacts.  SEI proposes a scope of work and fee totaling $55,102.75 broken down as follows: 
 
 
Property Survey (third-party) $24,027.75
Engineering Design and bidding $25,375.00
Miscellaneous $  5,700.00
TOTAL $55,102.75

Staff has held discussions with representatives of the Raintree Forest HOA and met on-site and they appear supportive of the project and willing to dedicate the required easements.  A pedestrian bridge will be required to cross a creek near the border between Witherspoon and Raintree Forest, and this engineering work will further explore this issue with the goal of determining a construction plan and design that results in construction of the trail in a cost effective manner.  Therefore, staff requests approval of the attached agreement with SEI.

Previous Commission Action
The Commission approved rezoning of the property for the Witherspoon subdivision at the January 13, 2015 meeting.  The approved plan included a stub for this proposed trail connection and the staff report for the rezoning included the following statement:

"If this trail improvement is constructed, staff would also recommend that the City eventually negotiate with the Raintree Forest HOA to undertake a project to connect the existing public trail along Raintree Parkway to the Holt Crest development across Raintree Forest open space to provide a complete public, off-road trail connection from Raintree Parkway to the nearby schools and Crockett Park."

Fiscal Impact:
Funding for these engineering design services has been allocated in the FY 2020 Capital Projects Fund budget.  Any adjustments to the future CIP funding needs will be made during the upcoming budget cycle.
