Resolution 2018-94 - A Resolution Authorizing Changes to the OSRD Development Plan for the Oman Property Subdivision

Subject
Resolution 2018-94 requests approval of minor revisions to the OSRD Development Plan for the Oman Property Subdivision, located at 900 Franklin Road.  Specifically, the proposal increases the area of the excess open space to 5.37 acres.  
Background
The attached resolution requests approval of minor revisions to the previously approved OSRD Development Plan for the Oman Property Subdivision.  

At its November 5, 2018 meeting, the Planning Commission voted unanimously, ten for and zero against (10-0), to approve a preliminary plan for the Oman tract. The property was rezoned pursuant to Ordinance 2018-12, which was approved by the Board of Commissioners on September 27, 2018. As part of their review, the Planning Commission also voted, again unanimously, to forward a recommendation of approval of the revised OSRD Development Plan to the Board of Commissioners. 
 
A comparison of the approved and proposed OSRD Development Plans is shown in the following table.

The proposed plan also adjusts the areas of six lots within the project. All lots within the project now exceed one acre in area.  Additionally, that area of the right-of-way also increased from 0.04 acres due to slight adjustments in the alignment of the road.  

The preliminary plan shows an excess open space of 5.37 acres.  The approved OSRD Development Plan showed 5.33 acres. Because the permanent open space for the subdivision is affected, the Board of Commissioners must approve the revised OSRD Development Plan by resolution per Section 78-185(b) of the zoning ordinance. 
 
The developer has agreed to contribute $75,000 as its share of the cost of the materials and installation of the traffic signal at the intersection of Franklin Road, Fountainhead Drive and the new subdivision street. The contribution shall be provided to the City before any permits will be issued for the project.  

Staff received the Traffic Signalization Assessment (TSA) prepared by Neel-Shaffer, which is attached below. The report will be submitted to TDOT for their staff review with notice that the City plans to proceed with engineering design for the signal. The TSA proposal will require City Commission approval before any design work can begin. Once design is complete, the construction will have to be competitively bid. Finally, fabrication of the mast pole arms it will take several months after they are ordered, based on prior experience.

Previous Commission Action
On September 27, 2018 the Board of Commissioners voted unanimously, five for and zero against (5-0) approving the proposed ordinance on second and final reading.  

At their August 27, 2018 regular meeting the Board of Commissioners voted five for and two against (5-2) to recommend deferral of second and final reading of Ordinance 2018-12 for one month to be considered at their regular meeting of September 27, 2018. 

At their August 13, 2018 regular meeting the Board of Commissioners conducted the required Public Hearing for Ordinance 2018-12. A total of nine citizens spoke at the meeting.  

At their regular meeting of July 9, 2018, the Board of Commissioners voted unanimously, six for and zero against (6-0) to approve Ordinance 2018-12 on first reading.
