Resolution 2025-80 - Approval of Agreement for Outside City Sewer Connection.
Background
The subject property for which extension of service is requested is located at 1004 Holly Tree Gap Road. The property includes an area of approximately 8.7 acres and is located on the north side of Holly Tree Gap Rd., near the intersection of N. Berry’s Chapel Rd., outside city limits, and within the City's Urban Growth Boundary (UGB).  The property is currently zoned by Williamson County as Municipal Growth Area -- 1 (MGA-1). The intent of the MGA-1 district is to provide areas adjacent to cities to remain largely undeveloped.  These areas are considered a part of the County’s rural landscape and as such, this district is established to protect the rural character of Williamson County by allowing for agricultural, rural, and low-density residential development. The minimum lot size required is one acre.  The County maximum gross density is one dwelling unit per acre. 
 
The applicant is requesting connection to city sewer for the existing residence and plans to make renovations for additional square feet.  Sewer service can be extended to the subject property via a low-pressure grinder system from the public sewer main located at the intersection of N. Berry’s Chapel Rd. and Cold Stream Drive.  See attached site map.  Because the property is located within the City's UGB it was included in the sewer system master plan evaluation and modeling for the ultimate sewer system build out.  As required by City and Water Service Department standards, the property owners would be required to fund the installation of the sewer infrastructure to the subject property.  The current property owners have agreed to fund the extension of the public sewer as needed and at their expense and pay all applicable out-of-city tap fees.  Additionally, city code further requires the payment of $1,900.00 grinder pump replacement fee. Payment of this fee allows the property owners to participate in the City's grinder pump maintenance program.  
 
There are no plans to subdivide the property by the owner.  If approved, the sewer extension authorization will only be for service to the existing main dwelling unit.  No additional structures on the property will be allowed to connect to the City's sewer system without prior approval under municipal code.  These limitations will be specifically addressed in a sewer service agreement that will be recorded with the Register of Deeds and will be binding on any future property owners.  Accordingly, Staff is recommending approval of the connection to city sewer, and of Resolution 2025-80, which authorizes the City Manager to enter into an agreement which memorializes the conditions for the extension.
