Resolution 2018-84 - Authorizing a Lease Agreement with Gerry Abrams for the Property at 9551 Split Log Road

Background

Pursuant to the agreement reached for the sale of the property at 9551 Split Log Road (Ordinance 2018-17), it was agreed that the current resident (Gerry Abrams) shall have a right to remain in the home for up to 24 months after closing to allow him time to find/build suitable replacement housing. The lease terms include occupancy for the first 12 months with the lease payment to be $200 per month, which approximates to the property taxes due for the property. If occupancy continues after 12 months, it will be on a month-to-month "holdover" basis with a monthly lease payment of $2,000.

The tenant will be responsible for all property maintenance and utility charges and will be required to obtain renter's liability coverage in the amount of $350,000. In addition, the City and the tenant will split the cost of a home warranty policy for the property. Finally, the City will have the right to post a sign identifying the property as the future site of Fire Station 5 and will also have access to the property as needed for any preliminary station design or site preparation studies.

The lease will begin immediately after the City completes the purchase of the property. Should you have any questions, please contact the City Manager or City Attorney.

Staff Recommendation

Staff recommends approval of Resolution 2018-84 authorizing the lease of the property at 9551 Split Log Road to Gerry Abrams.
