Resolution 2019-06 - Authorization to Acquire Easements for Maryland Farms Greenway Trail Project

Background

Engineering design work is nearing completion for the planned trail connecting Powell Park to Maryland Way Park via the Maryland Farms Greenway. The schedule calls for bidding the project the first quarter of 2019 with construction during the summer and fall time period.

To maintain projected schedules, the City needs to proceed with acquisition of permanent pedestrian access easements on three tracts (Maryland Farms Property Owners Association, YMCA, and Jordan Properties) and temporary construction access easements across one or more adjacent commercial properties to the north of the Greenway. (See attached exhibits). Therefore, staff is recommending that the City Commission provide formal authorization for the Mayor, City Manager and City Attorney to negotiate, acquire and condemn (if necessary) sufficient easements to allow this project to move forward. Note that staff has had multiple conversations with the owners of the three tracts where permanent pedestrian access easements are required, and all three are in favor of the project, subject, of course, to formal easement dedication negotiations.

Previous Commission Action

A design services agreement for this project with Sullivan Engineering was approved by the City Commission on April 23, 2018 via Resolution 2018-33.

Fiscal Impact:

While the staff expects that some easements will be dedicated at no cost to the City, compensation of some property owners is likely. The value will be determined via market appraisals.
