Resolution 2019-03 - A Resolution Authorizing Changes to the OSRD Development Plan for the Avery Subdivision

Resolution 2019-03 requests approval of minor revisions to the OSRD Development Plan for the Avery Subdivision, which is located on the east side of Murray Lane approximately 0.25 miles south of the Scales Elementary School.
Background
The attached resolution requests approval of minor changes to the OSRD Development Plan for the Avery Subdivision. The changes involve the elimination of two small circular islands, both are located in the cul-de-sacs on Penrose Drive and Steadman Court. The islands were originally designated as open space. The islands each include an area of 616 square feet for a total of 1,232 square feet.  Experience has shown that these small islands in cul de sacs result in problems with future road maintenance/repaving as well as large vehicle access.

At their regular meeting of December 3, 2018 the Planning Commission voted unanimously, nine for and zero against to approve a revised preliminary plan that removed the area of the islands from the open space for the subdivision.  The currently approved OSRD Development Plan for the project included a total of  6.85 acres of excess open space. The changes reduced the area of the excess open space by 0.02 acres, to a new total of 6.83 acres. As part of the review, the Planning Commission also voted to recommend approval of the corresponding changes to the OSRD Development Plan to the Board of Commissioners. Additionally, as part of the December agenda, the Planning Commission also approved a revised final plat that reflects the changes as shown on the preliminary plan.  Both approvals were conditioned upon the approval of the revised OSRD Development Plan by the Board of Commissioners.  

Since the revisions affect the permanent open space for the project, approval of the revised OSRD Development Plan by the Board of Commissioners is necessary, per the requirements of Section 78-185(b) of the Municipal Code.

Staff Recommendation
Staff recommends approval of Resolution 2019-03.  
Previous Commission Action
At its March 13, 2017 meeting, the Board of Commissioners approved Resolution 2017-17, which authorized acceptance of a multi-purpose pedestrian easement traversing the arterial road buffer along Murray Lane in the Avery Subdivision.  

At its January 10, 2017 regular meeting, the Board of Commissioners voted to approve Resolution 2017-01, which authorized an alteration to the improvements within the arterial road buffer along Murray Lane reducing the length of the multi-purpose trail within the arterial road buffer approximately 333 feet, or from 1,533 linear feet to 1,200 linear feet. The approved plan also increased the area of the permanent open space for the project from 5.83 acres to 6.85 acres.  

On June 14, 2016 the Board of Commissioners approved Resolution 2016-29, which authorized changes to the OSRD Development Plan for the Avery subdivision.  The changes involved a reduction of one lot, to a new total of 23 lots, an increase in the area of the excess open space and a modification to the improvements within the arterial road buffer (open space) for the project.

Also at its June 14, 2016 regular meeting the Board of Commissioners voted to approve Resolution 2016-30, which authorized acceptance of a stream mitigation plan for the Avery subdivision.  The mitigation area is within Primm Park, located along the south side of Moores Lane.  

On October 12, 2015 the Board of Commissioners voted unanimously, seven for and zero against to approve Ordinance 2015-11, which rezoned the property for Avery subdivision and adopted the OSRD plan.
