Resolution 2018-07 - Waiving the required connection to public sewer for 9236 Old Smyrna Road

Background

Section 78-170(b) of the Municipal Code requires any owner of an existing platted lot of less than five acres who wishes to obtain a building permit for construction of a single-family home to connect to the public sewer system. When the public sewer is not available to the property, the Board of Commissioners may approve a waiver for connection to the public sewer if a septic system or other private sewage facility is approved in advance by the Williamson County Health Department.

The owner of a 2.60 acre platted lot located at 9236 Old Smyrna Road has applied for a single family residential building permit and has received approval from the County Health Department to install a septic system to serve the residence once constructed. Accordingly, staff is recommending approval to waive the required connection to the public sewer system since public sewer is not available to this lot. Sewer availability is defined as being within 200 feet of any boundary of a lot per Article II, Division 1 of Section 70-26 of the Brentwood Code. (See attached map.)
