Second and final reading of Ordinance 2016-13, rezoning approximately 4.49 acres of property located along the west side of Edmondson Pike from AR (Agricultural Residential) to R-2 (Suburban Residential).
Background
Ordinance 2016-13, if approved, will rezone 4.49 acres of property, located on the west side of Edmondson Pike, approximately 300 feet south of its intersection with Whetstone Boulevard.  The subject property is comprised of three parcels, owned by two entities. In their current configuration the lots do not meet the technical standards of the AR zoning district, including the three acre area requirement.  However, they are grandfathered as nonconforming lots of record. The lot data are shown in the following table.

The northernmost existing lot, Parcel 00400, has a configuration similar to a "backwards seven", a portion of which runs behind, or west of the other two lots that are part of the request.  As shown on the attached concept plan, if the request is approved, the existing boundary lines of Parcels 00500 and 00601 will be extended to the westerly property line of the subject property, creating three R-2 compliant lots, having new areas, also shown in the table above. The proposed rezoning would not allow for more lots than exists today nor could the properties be further subdivided in the future.  The current zoning of the property to the west of the tract is OSRD (Whetstone Subdivision), while the property directly across Edmondson Pike is zoned R-2 and R-1.

The R-2 development standards require a 50-foot wide landscaped buffer along an arterial street (Edmondson Pike) and a 100 foot setback from the buffer. Essentially, any new or future development must comply with the current requirements of the district.  

There are existing structures located on the northern and southern parcels.  The middle parcel is currently vacant. The lot located at 786 Edmondson Pike includes one home with an area of 3,372 square feet and two accessory structures.  The lot located at 808 Edmondson Pike includes one home with an area of 2,233 square feet.  

The proposed rezoning was approved on first reading by the Board of Commissioners on November 14, 2016. 

The required community meeting was conducted at the Library on December 13, 2016.  One citizen, who had recently moved across the street from the subject property, attended the meeting but did not express any objections to the proposal.  

At its regular meeting of January 3, 2017, the Planning Commission voted eight for and zero against to recommend approval of Ordinance 2016-13 to the Board of Commissioners.

Staff Recommendation
Staff has reviewed the proposed rezoning application and the associated plans and has found that it complies with the applicable provisions of the Zoning Ordinance for consideration by the Board of Commissioners.
Previous Commission Action
On January 10, 2017, the Board of Commissioners conducted the required public hearing for Ordinance 20-16-13.  No one spoke either for or against the proposed ordinance.  

On November 14, 2016, the Board of Commissioners voted unanimously, six for and zero against (6-0) passing Ordinance 2016-13 on first reading.
